Missed Speech-Language Sessions in Schools

Background

School-based members across the country express concern about local and state policies that require making up missed speech-language sessions. There is great variation among states and districts in terms of these established policies. In response, ASHA requested guidance from the U.S. Department of Education, Office of Special Education Programs (OSEP).

On January 12, 2016, OSEP reaffirmed its 2007 guidance and reiterated that IDEA law and regulations do not address these issues but explained that states and local education agencies are required to provide a free and appropriate public education (FAPE) to all children with disabilities. Whether an interruption of services constitutes denial of FAPE  is an individual determination that must be made on a case by case basis.
