The U. S. Department of Education (ED) has reportedly sent the IDEA Part B final regulations to the Office of Management and Budget (OMB). The review by OMB is usually the last step before federal regulations are published. It is still expected that the final IDEA Part B regulations will be published in the Federal Register early to mid-August.
After ED drafts the regulations and it clears the approval process at ED, it then goes to the OMB which is the office within the White House that reviews the regulations. OMB makes sure that they are in compliance with other laws and regulations, responsive to the community, and address elements of the law that are necessary. If anything is missing OMB offers comments back to ED. ED must satisfy OMB management and budgetary concerns before the regulatory action can be published.
