Honoring Patient Choices: The Ethical Obligations of Audiologists and SLPs

Each day, audiologists and SLPs make treatment recommendations based on the best available evidence, their clinical judgment, and patients’ values. However, in some cases a patient and his or her family may decide not to follow those recommendations and choose a different path. These situations can leave a clinician feeling ethically challenged and legally vulnerable. This program addresses a patient’s right to choose and how those choices affect the clinician’s practice. Specific case studies will illustrate how the ASHA Code of Ethics supports and guides the clinician’s behavior and how clinicians can best balance patient choice with health and safety. Legal issues such as liability and licensure will also be addressed.

Learning Outcomes
You will be able to:

  • describe basic patient rights and how to determine decision-making capacity
  • distinguish legal decision-making capacity from the ability to make basic decisions about daily care
  • discuss key points that must be considered when balancing patient choice and safety
  • apply appropriate aspects of the ASHA Code of Ethics (2010) to situations where patients decide not to accept clinician recommendations
  • reference applicable ASHA Issues in Ethics Statements
  • discuss the potential legal implications of supporting patient choice (e.g., licensure)
