During the investigation of dysphagia malpractice issues, the expert witness may ask the following questions when reviewing your dysphagia medical records:
1. When did you provide professional services in the timeline of events leading to the alleged negative dysphagia management outcome and what was your role? Were you provided, in a clear and timely manner, with a dysphagia evaluation and treatment order? Did you respond to the order in a timely manner?
2. Do the records show that you displayed clinical proficiency and competency in the performance of your professional responsibilities with respect to the dysphagia? Do your records clearly show from what information you drew your clinical decisions and the reasons for your actions?
3. Do the records show that you recommended, in a timely and clear manner, a video swallow study? Did you provide a comprehensive bedside evaluation and did it include review of the patient's medical history, not only at your facility, but also at other facilities and home health agencies?
4. Do the records show that you performed dysphagia treatment at or above current, general, and accepted professional standards? If the video swallow study showed aspiration, or the potential of aspiration, did your treatment contribute to the patient suffering negative dysphagia management outcomes? Did you recommend follow-up video swallow studies to confirm the results of treatment?
