CMS Issues Guidance on Therapy Caps Suspension

The Centers for Medicare and Medicaid Services (CMS) has issued Transmittal 42 (PDF format), which provides guidance on the suspension of the therapy caps.  As previously reported, for 2003 implementation of the $1590 limitation on therapy services was delayed until September 1, 2003 by various advocacy actions initiated by ASHA and other rehabilitation groups.   The therapy caps were in effect for services rendered on September 1, 2003 through December 7, 2003.  Congress re-enacted a moratorium on financial limitations for outpatient therapy services that was signed into law on December 8, 2003 and extends through December 31, 2005.

In its transmittal, CMS notes that claims for therapy services received on or after December 8 will no longer be subject to the cap.  For additional information, please contact Ingrida Lusis, ASHA's Director of Health Care Regulatory Advocacy, at 800-498-2071, ext. 4482.
